Hybrid offences

The majority of offences under the Criminal Code are offences where Crown has the choice whether to proceed summarily or by way of indictment. This decision will depend on the seriousness of the alleged offence and the time period since the alleged offence has been committed. The Crown cannot proceed by way of summary conviction if the alleged offence occurred more than six months before the criminal charge against the accused was laid. There is no similar time limitation if the Crown is proceeding by way of indictment.
