Criminal Charges


Assault is direct or indirect intentional application of force to another person without that person's consent. Consent may not be obtained by force, threats, of deceit. In some circumstances accused person may also be guilty of assault where he or she attempts or threatens to apply force to another person.

The maximum penalty for simple assault, where the Crown proceeded by way of indictment, is five years imprisonment.

The maximum penalty for assault, where the accused person carried, used or threatened to use a weapon, or caused bodily harm to the complainant, is ten years of imprisonment, where Crown proceeded by way of indictment.

The maximum penalty for sexual assault is ten years imprisonment, where the Crown proceeded by indictment.
