Criminal Law Vocabulary


The concept of possession often comes up in criminal law in the context of offences dealing with weapons, stolen property, or illegal substances. In order for the Court to make a finding that the accused person was in possession of an illegal item, the Crown must prove beyond reasonable doubt that the accused person had both knowledge and control of the item in question. It is not enough to convict the accused person if the Crown is only able to prove one of these two elements.
